The vast majority of our matters involve educational issues for students who have or are eligible for an IEP. BIRG represents families with students aged Birth to 21, who have brain based disorders in all matters of special education law that arise under the federal Individuals with Disabilities Education Act (IDEA) and New York State Education Law. We assist those families in developing Individualized Education Plans (IEP), attend IEP meetings, review evaluations and related documentation, file due process complaints, negotiate settlement agreements, as well as represent and litigate on behalf of families in Impartial Hearings and before federal and state administrative agencies and courts.
BIRG believes these services should be barrier free to even low-income families with children with disabilities who are the most vulnerable. While we specialize in traumatic brain injury or brain based disorders, we provide legal representation and in-depth advocacy to all persons with developmental disabilities. Our staff advises parents of their legal rights, negotiates on their behalf, and represents them in administrative hearings to obtain the services their children need to support their development, succeed in school, and maximize their independence. While we have represented families from all over, we primarily represent families in the NYC tristate area. We also have represented many families who are moving to, or back to the New York metropolitan area.
BIRG recognizes that the first five years have the greatest impact on infants and toddlers with developmental delays and developmental disabilities. BIRG provides individual case assistance, referrals, community education, and policy advocacy to improve access to early childhood education. Early childhood education includes Early Intervention and CPSE (Committee on Preschool Special Education) services. We also help families navigate and acquire respite services and Medicaid Waivers to those that need it the most.
BIRG protects and promotes the educational rights, through advocacy, counsel, parent workshops and training for school aged students with disabilities. Our team specializes in special education law with an emphasis on Traumatic Brain Injury and brain based disorders. Our staff advises parents of their legal rights, negotiates on their behalf, and represents them in administrative hearings to obtain services their children need to support their development and to maximize their independence and ensure they receive a Free and Appropriate Public Education to meet their unique needs.
The main goal of IDEA is to prepare students for further education, employment, and independent living. BIRG assists and advocates for services that are available to meet their unique needs and prepare them for further education, employment, and independent living to have meaningful lives that help them to become actively involved in their communities.
